New York Disability Benefits Law & Paid Family Leave

The Disability and Paid Family Leave Benefits Law provides weekly cash benefits to replace, in part, wages lost due to injuries or illnesses that do not arise out of or in the course of employment and for paid time off to bond with a new child, care for a family member with a serious health condition or assist loved ones during a military deployment.

Qualifying Leave Reasons

Employee’s own non-work-related illness or injury

Benefit Waiting Period

Benefit Amount

50% of average weekly wage

Maximum Weekly Benefit

$170 (effective 5/1/1989)

Maximum Benefit Duration

26 weeks 

  • No more than 26 weeks in a 52-week period combined between DBL & PFL
  • Cannot take DBL & PFL at the same time

Contributions

Employee: 0.50% of employee taxable wage base not to exceed $0.60 per week

Employer: Remainder of the cost

 

Paid Family Leave 

Qualifying Leave Reasons

  • Bond with a new child (birth, adoption, or foster care placement)
  • Care for a family member with a serious health condition
  • Assist loved ones when a spouse, domestic partner, child, or parent is deployed abroad on active military service

None

Benefit Amount

67% of average weekly wage

Maximum Weekly Benefit

$1,228.53 (effective 1/1/2026)

Maximum Leave Duration

12 weeks 
  • No more than 26 weeks in a 52-week period combined between DBL & PFL
  • Cannot take DBL & PFL at the same time

Contributions

  • 0.432% of employee gross wage (effective 1/1/26)
  • Employee paid (employer can decide to pay some or all of the cost)
